Short-term lease agreement

​​

TERMS AND CONDITIONS OF THE SHORT-TERM LEASE AGREEMENT

​​

These terms and conditions apply between 2ndhomes Tampere Oy (Business ID 2889484-3) (later 2ndhomes Tampere) and the Customer when the Customer rents a furnished apartment from 2ndhomes Tampere or buys other services, and when 2ndhomes Tampere provides these services to the Customer.

The parties of the contract are the Customer and 2ndhomes Tampere, who have agreed on providing residential apartment rental services, and other services. In addition, any booking conditions for a rental platform, such as Oikotie.fi, Vuokraovi.com, AirBnB, Booking.com or Expedia, will apply to the booking of apartment rental and other services.

Customer's responsibility and disclosure of the content of the rental / service agreement

​​

The Customer is the person who has rented the apartment or made a reservation for the service, any person visiting the rented apartment and any person living in the apartment. The person who has made the lease agreement, and thus accepted these terms and conditions, is primarily responsible for fulfilling all the obligations, and for any damages arising from the lease and for complying with the rules relating to the lease. The person making the rental is obliged to ensure that the persons living or staying in the apartment are aware of all the provisions, terms & conditions and obligations concerning the use of the apartment.

The person who has rented the apartment is obliged to immediately inform 2ndhomes Tampere Oy in writing to tampere@2ndhomes.fi before the start of the lease and during the lease, when the resident or residents living in the apartment change, such as personal identification numbers and telephone numbers.

Origin and validity of the agreement

​

The rental agreement made by the Customer is binding on the contracting parties after the Customer has made a reservation for the rental of the apartment, unless otherwise agreed. 2ndhomes Tampere Oy may require the Customer to make a reservation or advance payment before the lease agreement becomes binding on the Customer, i.e., before any free cancellation period of the rental expires. The free cancellation period is always announced separately when renting on a platform that provides a rental apartment. If there is no mention of a free cancellation period, there is no free cancellation period applied. No interest is paid on rental deposit and/or booking or advance payment for apartment rentals. The short-term lease is valid for the period specified in the agreement.

The rental/service agreement will take effect in full with all of the terms and conditions without separate confirmation as soon as any free cancellation period expires or the booking fee or rental deposit has been paid. Otherwise, this agreement will take effect in full, with all of its terms and conditions, as soon as the confirmation of the rental of the apartment has been delivered to the Customer on the platform providing the services or to the e-mail provided by the Customer. The Customer has the right to cancel the rental for one (1) hour from the delivery of the terms of the contract if they do not accept them. Otherwise, the lease is considered approved with all the terms and conditions, even without a separate signature or other confirmation. Any cancellation of the rental must be made in writing to tampere@2ndhomes.fi.

2ndhomes Tampere Oy has the right to invoice the Customer for the extended term of the lease / service agreement in accordance with the criteria set out in the agreement. 2ndhomes Tampere Oy also has the right to charge the Customer for all costs and expenses incurred due to the Customer's failure to fulfill its obligations under the Agreement in a timely manner.

Responsibility

​​

Once a binding rental/service agreement has taken effect, the Customer is obliged to pay the payments agreed in the agreement no later than on the due date in accordance with the payment terms of the agreement or the payment terms of the service platform used.  

​​

Delayed payments

​​

2ndhomes Tampere has the right to charge 8% interest on late payments from the due date. In the case of the consumer, however, the default interest rate is determined by the Interest Act. A handling fee of EUR 5 will be charged for the payment request.  

​

Disclosure obligations of the Customer

​​

When making a reservation for renting an apartment, the Customer must provide the correct personal information required by law or otherwise the personal information required for the rental operations of 2ndhomes Tampere. If the above information has been provided incorrectly when making the rental, the Customer must correct this information immediately by notifying tampere@2ndhomes.fi in writing. Upon request, the customer must prove their identity before collecting the apartment keys by submitting a copy of their identity certificate to 2ndhomes Tampere. The Customer must also prove his or hers identity when collecting the apartment keys. If the Customer does not provide the requested personal information, 2ndhomes Tampere has the right to not hand over the keys to the rented apartment. This does not remove the Customer's obligation to perform their obligations under the Agreement.

Obligations related to the use of the rented apartment/property

​​

The customer is allowed to use the rented apartment for rent for normal living and being. The apartment or part of it may not be handed over for the use of another person or persons unless this has been agreed in advance with 2ndhomes Tampere in writing. The customer needs to be over 18 years old to rent the apartment.

​​

a. The customer must take care of the rental apartment and its furniture and equipment carefully, and use the apartment, furniture and equipment only for their normal purpose.

b. It is forbidden to cause any disturbance in the apartment, and the Customer must not disturb those living in the vicinity of the apartment. During living, the rules of the housing association, the instructions and regulations issued by the authorities and the legislation must be observed. It is the Customer's responsibility to clarify and understand these instructions and rules of procedure.

c. Smoking is not allowed in the apartment or other premises of the property related to the apartment.

d. It is not allowed to engage in criminal activities in the apartment.

e. Making copies of the apartment keys is prohibited.

f. Animals may not be kept in the rented apartment without the prior written consent of 2ndhomes Tampere. 

g. No candles or candlesticks are allowed to use in the apartment.

In addition, the Customer is obliged to ensure that:

  • the common areas of the apartment and the property remain clean and correct

  • the lights and electrical equipment are switched off and the water taps and connections are closed when leaving the apartment and while the customer is sleeping

  • the doors are locked and the windows are closed whenever the Customer leaves the apartment

  • the keys to the apartment and any door codes will not be in the hands of outsiders or lost

  • in the apartment no repair or alteration work or any other construction work is carried out in the apartment

  • there are no parties held in the apartment without written permission of 2ndhomes Tampere Oy.

If the Customer has violated the obligations above, the short-term rental agreement has been violated, in which case the person who violated the agreement may be immediately removed from the apartment. In such a case, the removed person may not claim a refund of the payments made, compensation or a discount from the agreed price, but shall be obliged to fulfill the obligations under the remaining contract period.

In addition to full compensation for any damage to the apartment, 2ndhomes Tampere has the right to charge a one-time payment of +100 euros to the Customer if the Customer violates the short-term lease agreement. The amount of the one-time fee will be determined according to the table below:

​

Penalty +100 euros:

  • Damage to furniture, fixed furnishings or parts of an apartment for less than 100 euros

  • Bringing a pet or other animal into the apartment without separate written permission from 2ndhomes Tampere.

  • Violation of the silence of the housing association and / or disturbance of the neighbours and having the police, the neighbor or a representative of the housing association contact the representative of 2ndhomes Tampere.

  • Smoking in the apartment so that the smell of tobacco can be detected by the staff of 2ndhomes Tampere after the customer leaves the apartment

  • Organizing parties in the apartment

  • Admission of persons outside the short-term lease without the permission of 2ndhomes Tampere

  • Needing a person organized by 2ndhomes Tampere to open the door of the apartment

Penalty +500 euros:

  • Damage to furniture, fixed furnishings or parts of the apartment worth 100 - 500 euros

  • Loss of apartment key or keys

​​

Penalty of +1000 euros:

  • Breaking the silence of the housing association and disturbing the neighbours, which results in 2ndhomes Tampere receiving a written warning

​

Customer's personal goods

 

2ndhomes Tampere is not responsible for goods left in the apartment or public areas.

2ndhomes Tampere's right to enter the apartment to monitor its condition and care

​​

The customer must without delay allow a representative of 2ndhomes Tampere or the technical representative appointed by the housing association to visit the apartment. If necessary, a representative of 2ndhomes Tampere or a third party, such as the owner of the apartment, or a person authorized by him, has the right to inspect the apartment without the Customer's separate consent. If the Customer has ordered services from 2ndhomes Tampere that require a visit to the apartment, it is not always possible for 2ndhomes Tampere to give an advance notice of the time of visit to the Customer. ​

Notices related to the agreement

​​

When making a reservation, the customer must provide an e-mail address to which 2ndhomes Tampere can send notifications regarding the agreement at the customer's request. During the term of the short-term lease agreement, 2ndhomes Tampere may also send the Customer notices related to customer service by e-mail and SMS messages, which remind, among other things, of the contractual due dates and times, and / or other obligations.

Compensation for damage, inconvenience and disturbance

​

The Customer is obliged to compensate 2ndhomes Tampere in full for any damage caused by the Customer intentionally, by negligence or by other negligent conduct to the apartment, its equipment and furniture, other premises used by the Customer or third parties and their property. The cleaning and repairing costs caused by any lost or broken furniture and any unusual contamination of the premises used by the Customer must also be reimbursed in full. In addition to the additional charges mentioned above, the customer is liable for all damages and disturbances in the apartment.

The customer is also obliged to compensate 2ndhomes Tampere in full for the loss of income caused by the temporary closure of the apartment based on the average income of the corresponding period of the previous year, or 2ndhomes Tampere's best estimate if the apartment is found uninhabitable. or other negligent damage to the apartment, its equipment and furniture, other premises used by the Customer or third parties and their property.

2ndhomes Tampere is not responsible for any personal injury or property damage in the apartment. It is also the customer's responsibility to immediately notify tampere@2ndhomes.fi of any safety deficiencies they notice.  

​

Release from liability

​

The customer is released from liability if and only when 2ndhomes Tampere receives full compensation for the damage from the person who caused the damage, or from the Customer.

​

Notification of damage

​​

The customer must immediately notify 2ndhomes Tampere of any damage to the apartment. If the damage has occurred to anything other than the apartment's furniture, in addition to 2ndhomes Tampere, the maintenance company of the residential apartment building company must be notified immediately. A Customer who fails to notify is liable for any damage caused by the failure.

Force majeure

​

Force majeure includes, but is not limited to, water damage, accidents, fires, strikes, natural disasters, power outages, water and sewer problems, heating problems, Internet outages, and third-party maintenance, repairs, or other work. The force majeure encountered by 2ndhomes Tampere's partner is also considered to be the basis for the discharge of 2ndhomes Tampere.

Customer Communication & Marketing

​

In order to maintain the rental and customer relationship, 2ndhomes Tampere notifies the Customer of matters related to the services purchased by the Customer from 2ndhomes Tampere or the maintenance of the rental relationship. Customer messages may be sent electronically or by letter and may also include marketing. By accepting these terms and conditions and / or continuing the lease after the delivery of these terms and conditions, the Customer grants a marketing authorization to 2ndhomes Tampere. The customer can also prohibit direct marketing by contacting tampere@2ndhomes.fi separately in writing.

Right to terminate the contract by 2ndhomes Tampere

​​

2ndhomes Tampere has the right to terminate a short-term lease or other service agreement if it becomes apparent that the Customer violates these terms and conditions. The agreement terminates immediately upon service of the notice of termination, or later, if 2ndhomes Tampere has announced a later date. Upon termination, this Agreement shall retain its meaning as the basis for calculating the indemnities.  

 

2ndhomes Tampere has the right to terminate the agreement immediately on the following grounds, among others:

  • Outstanding payments

  • Transferring the right to use the apartment to a third party without the permission of 2ndhomes Tampere

  • Causing disturbance

  • Damage to the apartment or other premises used by the Customer

  • Failure to comply with the rules of procedure drawn up by the housing association and the authorities

  • Activities in violation of Finnish law have been or are being carried out in the apartment

  • The apartment is used for a purpose other than normal living and being, or the Customer allows third parties to live in the apartment who have not been notified to 2ndhomes Tampere in writing and have been designated as Customers.

2ndhomes Tampere reserves the right to hand over the keys. The keys will not be handed over to the person who made the booking or to a person authorized by him if it is suspected that the person is intoxicated, would cause disturbance in the apartment, or violates the terms of this agreement during the rental of the apartment. 2ndhomes Tampere reserves the right to assess the matter and may assess the matter unilaterally in the event of handing over the keys. If 2ndhomes Tampere decides not to hand over the keys to the Customer on the above-mentioned grounds, 2ndhomes Tampere has the right to charge the Customer a full fee for renting the apartment without transferring the right to use the apartment to the Customer.

If part of the agreement is or becomes invalid or void due to legal changes, an official order or for other reasons, the agreement is still valid in other respects.

​

Disputes arising from the observance of the short-term lease agreement, these terms and conditions of the agreement or other disputes between the parties shall be settled in accordance with Finnish law. All disputes, regardless of the nationalities and status of the parties in the proceedings, will be resolved in the Pirkanmaa District Court.
